IN THE MATTER OF EMERGENCY REGULATION OF THE LEVEL OF RAINY LAKE AND OTHER BOUNDARY WATERS IN THE RAINY LAKE WATERSHED

Supplementary Order
to the 18 January 2001 Consolidated Order Prescribing Method of Regulating the Levels of Boundary Waters.

WHEREAS the Commission issued a Consolidated Order on 18 January 2001 that, among other things, required Abitibi-Consolidated Corporation and Boise Cascade Corporation to fully open all gates of the dam at International Falls-Fort Frances whenever the level of Rainy Lake is in excess of 337.90 meters (1108.6 feet), as will occur occasionally when flood inflows are in excess of the outflow capacity;

WHEREAS a severe rainfall event has occurred in the Rainy Lake basin and in other nearby basins, delivering in some areas as much as 300 millimeters of rain, causing rapid rises in water levels, and prompting flooding concerns;

WHEREAS the Commission has been informed that the level of Rainy Lake now exceeds 337.90 meters (1108.6 feet) and that the level of Rainy Lake has likely not yet crested;

WHEREAS the Commission understands that, given extremely high levels of the Rainy River downstream of Rainy Lake, further releases of flow from the dam at International Falls-Fort Frances may negate emergency measures taken along the Rainy River to protect inhabitable structures threatened by high water levels;

WHEREAS the Commission understands that on 11 June 2002 the International Rainy Lake Board of Control directed Abitibi-Consolidated Corporation and Boise Cascade Corporation to remain at then-current outflow from the dam at International Falls-Fort Frances, where in addition to flow through the turbines 7 gates are open but 8 remain shut, and to establish additional means of monitoring changes in water levels on the Rainy River so that water level information is available both upstream and downstream of the dam at International Falls-Fort Frances;

WHEREAS the Commission understands that the water level immediately downstream of the dam currently cannot exceed 1087.7 feet while the turbines are running, and that shutting off the turbines will reduce outflows through the powerhouse;

WHEREAS weather predictions include the possibility of further precipitation over the next several days, with perhaps heavier rainfall occurring in localized areas;

NOW, THEREFORE, THE COMMISSION ORDERS AND DIRECTS THAT, notwithstanding the requirements of the Commissionís Consolidated Order of 18 January 2001 in the matter of emergency regulation of the level of Rainy Lake and of other boundary waters in the Rainy Lake watershed, in the light of the unusually heavy rains that have occurred in the area, the Commission hereby confirms the instructions which the International Rainy Lake Board of Control has provided to Boise Cascade Corporation and Abitibi-Consolidated Corporation on 11 June 2002 to deviate from the requirements of the Consolidated Order and to establish additional means of monitoring changes in water levels on the Rainy River, and authorizes the International Rainy Lake Board of Control to continue to provide instructions and authorize outflow deviations until 20 June 2002. The International Rainy Lake Board of Control shall endeavor to bring flows within the requirements of the Consolidated Order as soon as practicable, taking into account conditions upstream, downstream, and at the powerhouse. The International Rainy Lake Board of Control shall immediately inform the Commission of any other instructions or outflow deviations it so authorizes, and shall provide the Commission with a verbal report on the situation in the Rainy Lake watershed and on the Rainy River and downstream every two days beginning 14 June 2002. The International Rainy Lake Board of Control shall also promptly issue to media an announcement of any further such instructions or outflow deviations, and shall issue a final announcement when outflows are brought into compliance with the 18 January 2001 Consolidated Order.
